In accordance with letter b), point 1 of Article 2 and Article 7 of Law No.119 / 2014 “On the Right to Information” the transparency program for KESH sh.a. This program defines the legal framework of the activity of the authority under Law No.119 / 2014 “On the Right to Information”.

This program is evaluated as a concrete way through which the Business Society builds and enhances transparency in its institutional work, under the guarantee of Law No.119 / 2014 “On the Right to Information”.

KESH shall update the Transparency Program from time to time, in accordance with Article 5 (2) of Law No. 119/2014 “On the Right to Information”. According to the Law, the deadline for reviewing the transparency program may vary depending on the nature of each public authority, but in no case may be longer than 5 years.

The information made public in this program aims to make the work of the Public Authority transparent, through its detailed coverage on the official website www.kesh.al, as well as in the public reception facilities. The transparency program is reflected in the rubrics, texts / content, timeframe for its publication, how it is made public, and the relevant structure that produces or manages the document.

The content of the transparency program identifies the publication scheme, which reflects the menus where the document is addressed on the official website. In addition, any document is accessible in the schema as well.

Documentation made public will be updated in form and content. Official site of KESH sh.a. is built in a form that provides information to the public on request in easily understandable format. The sections of the official website also contain
information characterized by restrictions on the identification of personal data due to the privacy of individuals data subjects, etc.

II. GENERAL PRINCIPLES

The main principles underlying the Transparency Program of KESH JSC are:

The “right to information” is a constitutional right provided for in Article 23 thereof, accessible to all without exception.
Presumption of maximum publication of data: KESH sh.a. to the extent that it exercises public functions, the information resulting from its activity shall be published in accordance with the legislation in force.
Correct implementation of the law and legal provisions that specifically regulate the activity of the company.
The information is adapted in clear and comprehensible language.
The oversight body of public information procedures is the Commissioner for the Right to Information and Protection of Personal Data ”(hereinafter KDIMDP)
The transparency program shall be revised according to the same procedure through which its approval is made.
Public information on request should be:
• full;
• Accurate;
• up-to-date;
• simple in consultation;
• understandable;
• easily accessible;
• compatible with original documents in the possession of public authority.

III. INFORMATION WHICH IS PUBLISHED ON REQUEST

Information permitted for publication is expressly provided for in Article 7 of Law No.119 / 2014
“On the Right to Information”.

In accordance with this approved transparency program, KESH sh.a. makes available to the public on its website
www.kesh.al, and in the public reception facilities, the following categories of information:

KESH sh.a organizational structure;
Full texts of laws, bylaws, codes of conduct, policy documents, manuals or any other document related to the exercise of its functions and affecting the general public;
Location information of KESH sh.a. , working hours, name and contacts of the Right to Information Coordinator;
Monitoring and control mechanisms acting on public authority, including strategic work plans, as well as documents
containing indicators of authority performance;
Information on the procedures to be followed in making a request for information, mailing and email address for filing
requests for information, and procedures for appealing the relevant decision;
Information on services the company provides to the public, information and documents that are frequently requested, audit reports from the Supreme Audit Institution or other entities, documents containing performance indicators of the authority, and any other information deemed useful by the public authority ;
Any mechanism and procedure for making claims and appeals regarding acts or omissions of public authority, the procedure by which interested persons may express their opinions or influence in any other way the formulation of policies or the exercise of the functions of KESH sh.a., a simple description of the system used by the public authority for keeping documentation, types, types of documents, and categories of information made public without a request.
Information on procurement procedures, respectively, as provided by law no. 9643, dated 20.12.2006, “On public
procurement”, carried out on behalf of the public authority, including: list of contracts awarded, contracted amount,
contracting parties and description of contracted services or goods, implementation and monitoring information of
contracts, as well as various guidelines and policies Information on services the authority provides to the public, including quality of service standards, a description of the categories and forms of social assistance, subsidies provided by the public authority and the procedures for obtaining them, information and documents frequently requested, any other
information deemed useful by public authority.
The Public Authority shall also create and archive a digital copy of its official website, supplemented by the information required in the approved transparency program, as well as the methods, mechanisms and periodicity of the publication of public information, which are made available to the public. publicly available without request;

V. PUBLICATION

Në përputhje me këtë program transparence të miratuar, shoqëria KESH sh.a. vendos në dispozicion të publikut në faqen e tij të internetit www.kesh.al dhe në mjediset e pritjes së publikut, kategoritë e mësipërme të informacionit.

VI. MONITORING

Komisioneri për të Drejtën e Informimit dhe Mbrojtjen e të Dhënave Personale monitoron zbatimin e ligjit për të drejtën e informimit, duke nxitur parimin e transparencës në punën e autoriteteve publike, veçanërisht duke sensibilizuar dhe informuar për çështje të së drejtës së informimit.
Komisioneri bën rekomandime për autoritetet publike, lidhur me konceptimin dhe zbatimin e programeve institucionale të transparencës.
